Terms and conditions

These general terms apply to requests, quotes and work by Elektricien24service, a trading name of MASS B.V., at Van Middellandtstraat 19, 1057 AP Amsterdam, the Netherlands, Chamber of Commerce number 98841564.

2. Application

These terms apply to our quotes, order confirmations and contracts. Changes apply only if agreed in writing or electronically. Mandatory consumer rights always continue to apply.

3. An online request is not yet an order

A form submission, phone call or email is initially a request. A contract is formed after we expressly confirm the work, the price or pricing basis, the location and the schedule, or after we begin the work at your express request. An automatic acknowledgement of receipt is not a confirmed appointment.

4. Information from the customer

You provide accurate and complete information in good time about the fault, installation, location, access and known risks. Where relevant, you tell us about moisture, fire or smoke damage, asbestos, unsafe areas, previous changes, and restrictions imposed by a homeowners’ association (VvE) or landlord. Incorrect or missing information may affect scheduling, performance and price.

5. Quotes, estimates and costs

A quote states which work and costs are included. Unless stated otherwise, a written quote is valid for 14 days. An estimate is an assessment based on the information available, not a fixed contract price. Prices for consumers include VAT unless clearly stated otherwise.

Call-out charges, investigation, labour, materials, parking charges and any emergency or evening surcharges are discussed in advance insofar as they are known at that point. If the situation on site is substantially different, we explain the change required and ask for your agreement before doing additional work.

6. Appointments, access and preparation

You ensure that an authorised adult is present, that the work area is safe and accessible, and that necessary rooms, fuse boxes and connection points can be reached. You tell us in advance about equipment that must not unexpectedly lose power. If missing access or unsafe conditions make it irresponsible to proceed, we may suspend the work.

Time and arrival estimates are targets. Traffic, weather, earlier emergency jobs, availability of electricians and parts may cause delays. We inform you as soon as possible if an appointment changes substantially.

7. Urgent work and safety

In unsafe conditions, Elektricien24service may postpone or limit the work until it can be carried out responsibly. Do not take actions that could make an unsafe situation worse.

8. Performance and additional work

We perform the agreed work carefully and in accordance with the professional standards that apply to it. If additional work proves necessary, we first discuss its nature and cost with you. Only if immediate action is reasonably necessary to limit direct danger or serious consequential damage, and you cannot be reached, may necessary emergency measures be taken.

Work on sealed components or parts outside your own electrical installation is included only when expressly agreed and legally permitted. Repair of plaster, paint, tiling or carpentry is included only when expressly agreed.

9. Materials and changes

We may use an equivalent material or part when the agreed product is unavailable, provided its function, safety and quality remain appropriate and we discuss the change with you in advance if it is significant to you. Removed materials will be taken away if agreed; otherwise, they remain with the customer.

10. Cancelling and rescheduling

Let us know as soon as possible if you wish to cancel or reschedule an appointment. Cancellation or call-out charges are charged only if they were clearly communicated before the final appointment and validly agreed. Costs already demonstrably incurred at your request, such as specially ordered materials, may be payable by you insofar as the law allows.

11. Consumer right of withdrawal

If, as a consumer, you conclude a contract at a distance or away from our business premises, you generally have 14 days to change your mind. If you want us to start during that period, we ask for your express request. If you withdraw after work has started at your request, you may owe a proportional amount for the work already performed. The right of withdrawal may end once the work is fully completed if you expressly agreed beforehand to immediate performance and acknowledged that the right would then end.

Statutory exceptions may apply to the necessary urgent work for an urgent repair that you specifically requested. Extra services or parts that are not necessary for that urgent repair are not automatically covered by that exception.

12. Payment

You pay by the method and within the period stated in the quote, order confirmation or invoice. If a consumer does not pay on time, they first receive a legally compliant, free reminder and an opportunity to pay before collection costs are charged. Statutory commercial interest and reasonable collection costs may apply to business customers.

13. Completion, complaints and remedies

Check the work when it is completed insofar as reasonably possible. Report questions or complaints as soon as possible to info@elektricien24service.nl, clearly explaining the problem. Give us a reasonable opportunity to investigate the complaint and, where we are responsible, carry out an appropriate remedy. Your statutory rights to proper performance continue to apply.

14. Warranty

Any additional warranty and its duration are set out in the quote, order confirmation or product documentation. A warranty does not limit your statutory rights. A warranty does not cover normal wear and tear, misuse, changes by third parties, defects outside the work performed, or damage from external causes, unless the law provides otherwise.

15. Liability

We are liable for loss or damage insofar as it can be attributed to us under the law. The customer takes reasonable steps to prevent or limit damage. We are not responsible for defects that were not visible or reasonably discoverable beforehand, for incorrect information provided by the customer, or for work and parts supplied by third parties beyond our control.

For business customers, liability for indirect loss, such as lost profits, business interruption and loss of data, is excluded insofar as the law permits. No limitation applies to intent or deliberate recklessness by our management, and mandatory consumer rights are unaffected.

16. Engaged professionals and third parties

We may use employees, subcontractors or specialist partners to carry out the work. We remain responsible for our contractual obligations unless it is made clear that a separate contract is entered into with another service provider.

17. Force majeure

In circumstances beyond our reasonable control, such as extreme weather, infrastructure failures, inaccessible locations, government measures, staff illness or serious supply problems, we may suspend obligations for as long as the situation continues. We will discuss a new schedule with you. Mandatory statutory rights continue to apply.

18. Website and intellectual property

The content, design, text and images of this website may not be copied or reused commercially without permission, except where the law permits. Website information is general and does not replace an on-site assessment of your installation.

19. Personal data

We process personal data in accordance with our privacy statement. It explains which data we use, why, for how long, and what rights you have.

20. Changes and validity

The terms available when the contract is concluded apply to that contract. If a provision is invalid, the other provisions remain in effect, and the parties replace the invalid provision with a valid one that comes as close as possible to its purpose and intent.

21. Governing law and disputes

Dutch law applies to the contract. We first try to resolve a dispute together. If that does not succeed, the dispute is submitted to the court that has jurisdiction under the law. Consumers retain all mandatory rights concerning the competent court and applicable protection.
